Welcome to Spatial Clarity. These Terms of Service ("Terms") govern your use of the Spatial Clarity website and platform (the "Service") operated by Spatial Clarity. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Service.
1. Acceptance of Terms
By using the Spatial Clarity Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy. These Terms apply to all users, including but not limited to browsers, vendors, customers, merchants, and content contributors. If you do not accept these Terms, please do not use the Service.
2. Use License and Permitted Use
Spatial Clarity grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes related to home organization assessment and learning. You agree to use the Service only in ways that:
- Comply with all applicable laws and regulations;
- Do not infringe upon the intellectual property rights of Spatial Clarity or third parties;
- Do not transmit malware, viruses, or any code of destructive nature;
- Do not attempt to gain unauthorized access to the Service or its systems;
- Do not reverse-engineer, decompile, or attempt to derive the source code of the Service;
- Do not reproduce, duplicate, copy, or resell any portion of the Service for commercial purposes without explicit written permission;
- Do not use the Service to collect or track personal information of others without consent;
- Do not use automated tools, bots, or scrapers to access the Service without authorization.
Violation of any of these restrictions may result in immediate termination of your access to the Service.
3. Intellectual Property Rights
The Service, including all content, features, functionality, text, graphics, diagnostic frameworks, learning pathways, product prescription methodologies, and design elements, is the exclusive property of Spatial Clarity and its content providers. This includes but is not limited to the Symptom Library, Solution Pathways, Product Prescription Cards, Material Trade-off Guides, diagnostic flowcharts, room assessment methodologies, and all accompanying visual materials.
All intellectual property rights in the Service are reserved. You are granted a personal, revocable, non-exclusive, non-transferable license to use the Service solely for your own personal, non-commercial use. You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, or services obtained from the Service without prior written consent from Spatial Clarity.
The Spatial Clarity name, logo, and all related marks are trademarks of Spatial Clarity. Unauthorized use of these trademarks is prohibited.
4. User-Generated Content and Feedback
If you submit, post, or display content on the Service (including room photos, assessments, or feedback), you grant Spatial Clarity a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute that content for the purpose of improving the Service and providing organization consulting guidance. You represent and warrant that you own or have the necessary rights to all content you submit and that such content does not violate any third-party rights.
Spatial Clarity does not claim ownership of your personal data or information you provide during the diagnostic assessment process, except as necessary to deliver the Service and improve our recommendations.
5. Disclaimers and Limitation of Warranties
The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. Spatial Clarity disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title.
Spatial Clarity does not warrant that:
- The Service will be uninterrupted, error-free, or secure;
- Any defects in the Service will be corrected;
- The Service will meet your specific organizational needs or expectations;
- Organization solutions recommended through the Service will produce the exact results described or shown in before-and-after examples;
- Product recommendations will be available, suitable, or compatible with your specific space or needs;
- Any information provided is accurate, complete, or current.
The diagnostic assessments, learning pathways, and product recommendations provided by Spatial Clarity are educational guidance tools and should not be considered professional interior design, architectural, or structural engineering advice. Results vary based on individual circumstances, implementation, and ongoing maintenance.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Spatial Clarity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, or loss of business opportunity, even if Spatial Clarity has been advised of the possibility of such damages.
In no event shall Spatial Clarity's total liability to you for all claims arising from or relating to the Service exceed the amount you have paid to Spatial Clarity in the twelve (12) months preceding the claim, or if you have not made any payment, one hundred Turkish Lira (₺100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you. In such cases, liability shall be limited to the maximum extent permitted by law.
7. Indemnification
You agree to indemnify, defend, and hold harmless Spatial Clarity, its officers, directors, employees, agents, and successors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any applicable law or regulation;
- Your infringement of any third-party intellectual property rights;
- Any content you submit or display on the Service;
- Your implementation of recommendations or products suggested through the Service.
8. Third-Party Links and Services
The Service may contain links to third-party websites, products, and services that are not operated by Spatial Clarity. These links are provided for convenience only, and Spatial Clarity does not endorse, control, or assume responsibility for the content, accuracy, or practices of any third-party site or service.
Your use of third-party websites and services is governed by their own terms of service and privacy policies. Spatial Clarity is not liable for any loss, damage, or dispute arising from your interaction with third-party sites or services, including product purchases or recommendations made through external links.
9. Termination of Access
Spatial Clarity reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to:
- Violation of these Terms;
- Illegal or harmful conduct;
- Abuse of the Service or its resources;
- Non-payment of any fees (if applicable);
- Discontinuation of the Service or features.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Intellectual Property Rights, Limitation of Liability, Indemnification, and Governing Law) shall remain in effect.
10. Modifications to the Service and Terms
Spatial Clarity reserves the right to modify, update, or discontinue the Service or any portion thereof at any time without notice. Spatial Clarity also reserves the right to modify these Terms at any time. Changes to the Terms will be effective immediately upon posting to the Service. Your continued use of the Service following any modification constitutes your acceptance of the updated Terms.
It is your responsibility to review these Terms periodically for changes. If you do not agree to any modification, you must discontinue use of the Service.
11. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles. You agree that any legal action or proceeding arising from or relating to these Terms or the Service shall be subject to the jurisdiction of the courts located in Eyüpsultan, Marmara Region, Turkey.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
12. Severability
If any provision of these Terms is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect. The invalidity of one provision shall not affect the validity or enforceability of any other provision.
13. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Spatial Clarity regarding your use of the Service and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral.
